Bellevue police respond to video of 2018 incident

The video circulating on social media involving a use of force incident occurred on December 23, 2018. The Bellevue Police Department thoroughly reviews all use of force incidents and continually re-examines its policies and procedures to ensure they align with best practices. This particular incident was investigated through the department’s Use of Force review process and the department’s complaint process. It was found to be in compliance with department policy.

“I want the public to know that we take all use of force very seriously,” said Chief Steve Mylett. “The video is disturbing. When taken in its complete context the officer’s actions were determined reasonable for the resistance he was faced with. From the officer’s perspective, he believed the driver posed a threat to him and others in the area through her refusal to comply with his lawful repeated orders, continual efforts to remove her hand from her purse, and her attempts put the car in gear. As a result of the totality of the situation and the driver’s resistance, the officer used force to overcome the active resistance.”

Incident recap

On December 23, 2018, at approximately 11:00 am, the driver was stopped for suspicion of failing to transfer her automobile title, a violation of Washington State law. The driver refused every one of the officer’s repeated lawful commands, including producing her identification, showing her hands, and exiting the car. Instead, the driver reached inside her purse, despite the officer’s four separate commands not to reach into her purse. This action caused the officer to fear she was reaching for a weapon.  

The driver also left the car in gear and suddenly moved her hand to the gear-control; the officer believed she was attempting to flee or assault him with the vehicle. The officer repeatedly asked her to exit the vehicle, and she refused.  

When the officer removed the driver from her vehicle, she continuously refused to comply with the offer’s command to put her arms behind her back. As the officer attempted to take her into custody she pulled away from the officer and refused to be handcuffed. In order to prevent injury to the driver and himself, the officer took the driver to the ground, and based on the continued resistance, applied a vascular neck restraint technique.  video of BPD training with this can be found here.

The driver was arrested on charges of Refusing to Comply with Police, Obstructing a Law Enforcement Officer, Resisting Arrest, and Motor Vehicle Transfer of Ownership Violations.

The subject was not injured, and she did not file a complaint. Efforts to contact her to obtain a statement as part of the use of force review process were unsuccessful.

Officer placed on administrative leave

Late Tuesday, the Bellevue Police Department was alerted that an officer may have violated the department’s social media policy. The department immediately looked into the matter and determined there was reason to launch an investigation.  The Chief authorized an independent outside investigation to ensure complete transparency. The officer has been placed on administrative leave pending the outcome of the investigation.

We remind the public that Bellevue Police Department employees train and are guided by our core values of respect, integrity, accountability, and service. “We will allow the investigators to do their work fully and completely, and we’ll take appropriate actions at its conclusion,” said Chief Mylett.

Bellevue police investigate fatal stabbing

Two people died following a domestic disturbance in the 15500 block of NE 22nd Place just before 11:30 pm Monday, June 1st. Officers responded to a report of a stabbing where the suspect was believed to still be at the scene. 

When officers arrived, they found two victims a 57-year-old male and a 58-year-old female, with critical injuries.  The 30-year-old suspect was inside the residence, also with serious injuries.

The suspect is believed to be the victims’ son, and he was taken into custody. At this time, we believe his parents had traveled from Texas to visit their son in Bellevue.

Officers attempted life-saving measures, and the two victims were transported to the hospital. Unfortunately, they succumbed to their injuries. The suspect was arrested and is in police custody.

The investigation is ongoing.

Case # 20-26283

Three injured in domestic disturbance

A domestic disturbance in the 15500 block of NE 22nd Pl. has sent three people to the hospital. The call came in at 11:20 pm.  When officers arrived, they found a man and a woman, both in their 60s with serious injuries. A man in his 30s had unknown injuries. All three were transported to the hospital. Investigators have secured the scene, and there is no risk to the public.

Chief Steve Mylett’s statement regarding George Floyd’s death

This week, the world witnessed the senseless death of Mr. George Floyd while in custody of police officers charged to protect and serve. There appears to be no justification for the force used on Mr. Floyd, and what transpired that tragic day has now resulted in criminal charges against the involved officer.  The actions seen on video are not consistent with the training or values we promote in our profession. I cannot imagine the anguish, fear, and panic Mr. Floyd experienced as he begged the officer to allow him to breathe, only to have his pleas be rejected. I cannot imagine the hurt, anger, and frustration of Mr. Floyd’s family, friends, and community who look to the police for protection and fair treatment.  The public servants involved failed them all.

On behalf of the men and women of the Bellevue Police Department, I want to express my deepest condolences to Mr. Floyd’s loved ones on his tragic death. There is nothing that can bring him back, and I pray he is resting in peace.

Throughout the country, police chiefs are speaking out against the actions of the involved officer who placed his knee on the neck of Mr. Floyd and the officers who stood by and allowed it to happen. Over the past few days, I have met with my officers who’ve expressed disgust at how Mr. Floyd was treated and the reckless inactions of the officers who witnessed Mr. Floyd’s death.

Please know that when officers see acts of violence against citizens at the hands of police officers, most officers become as outraged as everyone else – in some ways, even more so. Why? Because most of the one million police officers who serve communities throughout this country do so with honor, integrity, and courage. They sacrifice their safety to protect others as they work hard to build trust and legitimacy in their communities. So, when an incident such as this happens, the results are erosion of trust between the public and the police in areas well beyond the actual incident, especially in communities of color.  That is certainly regrettable.

I want to reassure the Bellevue community that we at the Bellevue Police Department will continue to work hard to earn your trust through our actions.  Additionally, I reaffirm our commitment to stand beside each of you as we navigate the challenges of our times with the reassuring knowledge that we are stronger together.  We will continue to treat every human being with dignity, respect, and humanity.

A fond farewell, John McCracken

After nearly 35 years, Bellevue Police said farewell to Major John McCracken. McCracken’s a Bellevue native and started his career as a dispatcher in 1986, after graduating from Newport High School, Bellevue College, and the University of Washington.

He soon became a police support officer and then a Bellevue police officer in 1988. 

McCracken is a ‘cops cop.’  He is tenacious, competitive, and a team player.  “John always had your back,” said Sergeant Dave DeVore, who worked his entire career with McCracken. “But he also challenged you, everyone, and that made us all better cops at the end of the day.”

During his career, John was a patrol officer, a motorcycle officer, Field Training Officer, Patrol, and Traffic Unit Captain.  He also served as a Special Detail Unit Detective, SWAT Team Commander, Investigations Captain, and since 2017, as Investigations Major. 

“It’s difficult to underestimate the impact Major McCracken has had on BPD over the years; his leadership, energy, compassion, and ability to make even the most difficult jobs seem effortless will be missed,” said Assistant Chief Carl Kleinknecht.  “When John arrived on scene, you were confident the job would get done and get done well.”

Of the hundreds of cases McCracken’s investigated, the one that bothers him most is the Sky Metalwala case.  Sky vanished in 2011 and has never been found.  “We could never determine what happened to Sky. We know he didn’t disappear from Bellevue that day, and we suspect only his mom can tell us what happened to him,” McCracken said.

McCracken says he’s been lucky to have had some great assignments over the years, like getting paid to ride a motorcycle.  But his fondest memories are working with the Make A Wish Foundation helping kids who deserved a special day, including Electron Boy and Justice Boy.

“This has been an amazingly satisfying career.  I wouldn’t have wanted to do anything else. I’m lucky to have had the opportunity to serve the city where I grew up.”

The officer arrested him for Reckless Driving and Felony Eluding.  Witnesses in the neighborhood gave statements describing the suspect driving thru the neighborhood going 50-60mph.  The suspect was booked into jail.

The total price for the stolen items was $260.06. When contacted, the suspect had the stolen merchandise and also had suspected drug paraphernalia on his person, and it was learned that he had an active felony warrant. He was arrested and booked into jail without incident.

Officers responded to an assist call in reference to an earlier theft that occurred in Issaquah.  The victim indicated that their stolen iPhone was showing on GPS as being in Bellevue.  The officers used an app to ping the phone and located it in the suspect’s possession.  She was also in possession of the victim’s credit cards and Gucci wallet.  She was arrested and booked into jail without incident.  The stolen property was returned to the victim.

The victim was in the process of moving out of the house she and the suspect rent.  The suspect was intoxicated and upset the victim’s family who was there helping her.  The suspect retrieved a firearm and while out on the back patio began waving it around saying he wanted them out of the house.  As officers arrived, the suspect exited the residence unarmed.  Officers took the suspect into custody and located a silver revolver and a second handgun in plain view.  Both firearms and the ammunition were seized. The suspect was arrested and booked into jail.

A subject was moving his car that had been parked along the roadway in front of a second subject’s residence.  The second subject confronted the first one because the vehicle had been left for so long.  They got into an argument and the first subject felt threatened and sprayed the second subject with pepper spray.  Neither subject wanted to pursue charges.  A case report was taken for documentation purposes.

 NARRATIVE

An officer located a vehicle with a stolen license plate on the front and detained the two occupants.  The officer discovered that there was a different rear plate which was also stolen.  A check of the VIN revealed that the vehicle itself was stolen.  The vehicle was towed to the station for processing.  It was determined that the suspects were in possession of ten total stolen license plates, stolen credit cards, stolen mail, suspected drugs, and other items.  The female was booked into jail for multiple felony charges.  The male was booked into jail for a DOC warrant.  He is also a convicted felon for domestic violence order violations and will have multiple felony charges stemming from this investigation.

 NARRATIVE

Officer responded to a call regarding a hostile employee threatening customers. It was determined that the suspect had been working a 16-hour shift and was about to get off. He was irritated and getting angry for no reason, but no crime was committed so he was let go. A few minutes later, a hit and run occurred at NE 8th and 144 Ave NE, and then a collision at NE 8th and 124 Ave NE. Officers located the suspect at the collision at 124th. Numerous witnesses said they saw him just before the crash going upwards of 80-100 mph west on NE 8th St. As he approached 124th, he did not brake and slammed into the back of a stopped vehicle. The suspect sustained injuries to his hand. The victim car had one occupant and she sustained minor injuries. The suspect was identified as the driver in the hit and run. He was arrested and booked on reckless driving and Hit and Run.

Officer witnessed an occupied, unconfirmed stolen vehicle in the area of Bellevue Way and Main St. The vehicle abruptly pulled into a parking lot. The officer called out the contacts and verbally controlled the subjects until help arrived. The investigation revealed the vehicle was stolen out of unincorporated Snohomish County. It was taken during a residential burglary. The suspect was arrested and booked into jail.

The victim’s roommate called police because a suspect assaulted the victim.  Police arrived and the suspect barricaded himself in his bedroom.  The victim also advised that the suspect had a handgun, which he normally keeps in the bedroom.  Due to suspect refusing to come out, SWAT was requested.  After several hours, the suspect surrendered was taken into custody, and booked into jail.

The suspect decided he wanted to go back to “County,” so he proceeded to break and smash the glass doors in the main entrance area of the building. The investigating officer was able to obtain video and determine probable cause for the suspect. Building facility staff provided documentation verifying that the suspect caused over 7K in damage. The suspect was arrested and booked into jail without incident.

A suspect involved in a previous theft was recognized by loss prevention while he was in the store.  The suspect got into the passenger side of a vehicle and officers were able to make a stop on it. The suspect lied about his name. A caller reported that a person was confronting a subject in the parking lot. Officers arrived on scene and contacted a resident who apparently interrupted a prowl in progress. The resident was able to detain the subject for a short period with his dog, but the suspect eventually ran into a waiting vehicle and fled the scene. The victim’s property was recovered at the scene. The investigation is on-going.

A subject returned from California and an argument ensued with his roommate, who believed the returning subject should quarantine for two weeks at a hotel.  During the argument, the returning subject got angry and threw two punches, which caused minor injuries to his roommate.  Officers arrested the suspect for DV Assault 4th degree and booked him into jail without incident.
